§ 2-83. Powers of board.

  • The nuisance abatement board shall have the power to:

    (1)

    Adopt rules for the conduct of its hearings;

    (2)

    Subpoena alleged violators and witnesses to its hearing, which subpoenas shall be served by the police department or any person authorized by rules of procedure;

    (3)

    Subpoena records, surveys, plats and other documentary evidence, which subpoenas shall be served by the police department or any person authorized by rules of procedure;

    (4)

    Take testimony under oath;

    (5)

    Issue orders having the force and effect of law declaring that any place or premises constitutes a public nuisance, prohibiting any such nuisance, and commanding necessary steps to abate any such nuisance;

    (6)

    Establish and levy fines pursuant to section 2-92; and

    (7)

    Provide for continuing jurisdiction for a period of up to one year over any place or premises that has been or is declared to be a public nuisance.
